By accessing or using Lungoor AI, a product developed and operated by Surfboard India Pvt Ltd , you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must not use the service.

These Terms apply to all users of Lungoor AI, including individuals and businesses using the platform through the website or associated applications.

2. Age Requirements

Lungoor AI is available to users aged 13 and above. Users between the ages of 13 and 17 must have verifiable parental or guardian consent before creating an account or making any purchases. By creating an account, you represent that you meet this age requirement.

3. Description of Service

Lungoor AI provides AI-powered speech-to-text and productivity tools, including integrations with third-party providers to enable:

• Speech-to-Text processing via Soniox
• Language model processing via Google Vertex AI
• Product analytics via PostHog
• Cloud infrastructure services

Lungoor AI continuously improves its platform and features may change or evolve over time.

4. User Accounts

To access certain features of Lungoor AI, users must create an account. By creating an account, you agree that:

• The information you provide is accurate and complete
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

Lungoor AI reserves the right to suspend or terminate accounts that violate these terms.

5. Acceptable Use

Users agree to use Lungoor AI only for lawful purposes. You agree not to:

• Use the service for illegal or fraudulent activities
• Attempt to gain unauthorized access to the system or other users' accounts
• Reverse engineer, copy, or misuse the platform or its technology
• Use the service in a way that could damage, disable, or impair the platform

Violation of these rules may result in account suspension or termination.

6. Credits and Payments

Lungoor AI operates on a prepaid credit-based payment model. By purchasing credits, you agree that:

• All credit purchases are final and non-refundable once processed
• Unused credits do not expire and remain available in your account
• Refunds will only be considered in exceptional circumstances where Lungoor AI has failed to deliver the service due to a technical fault on our end
• Refund requests must be submitted to admin@lungoor.ai within 7 days of the incident

All refund decisions are at the sole discretion of Surfboard India Pvt Ltd.

7. AI-Powered Features

Users acknowledge that:

• AI-generated outputs may not always be accurate or complete
• AI results should be reviewed before relying on them for important decisions
• Lungoor AI does not guarantee the accuracy of AI-generated outputs

Users remain responsible for how they use AI-generated content.

8. Speech-to-Text Processing

Lungoor AI provides Speech-to-Text functionality via Soniox. Users acknowledge that:

• Audio is transmitted to Soniox solely for real-time transcription
• Neither Lungoor AI nor Soniox retains audio after transcription is returned
• Only STT usage counts are stored for monitoring purposes

9. Third-Party Services

Certain features of Lungoor AI rely on third-party providers including:

• Soniox for Speech-to-Text processing
• Google Vertex AI for language model processing
• PostHog for analytics

These providers process data only to deliver the requested functionality. More details can be found in the Privacy Policy.

10. Intellectual Property

All content, technology, software, and branding associated with Lungoor AI are the intellectual property of Surfboard India Pvt Ltd or its licensors. Users may not copy, distribute, modify, or reproduce any part of the platform without prior written permission.

11. Service Availability

Lungoor AI strives to provide reliable service but does not guarantee uninterrupted or error-free operation. The platform may occasionally experience:

• Maintenance downtime
• Infrastructure issues
• Third-party service interruptions

Lungoor AI is not liable for service interruptions beyond its control.

12. Limitation of Liability

To the fullest extent permitted by the laws of India, Surfboard India Pvt Ltd shall not be liable for:

• Indirect or consequential damages
• Loss of data or business interruption
• Errors or inaccuracies in AI-generated outputs

Use of the platform is at the user's own risk.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or in connection with the use of Lungoor AI shall be subject to the exclusive jurisdiction of the courts of Thane, Maharashtra, India.

14. Changes to Terms

Lungoor AI may update these Terms from time to time. For material changes, we will notify registered users by email at least 7 days before the new terms take effect. Continued use of the service after an update constitutes acceptance of the revised terms.
