Last updated: Sep 18, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Lungoor Notes, part of Lungoor, a suite of AI-powered productivity products developed and operated by Surfboard India Pvt Ltd, including Lungoor Voice, Lungoor Notes, and future Lungoor services.

By accessing or using Lungoor Notes, you agree to be bound by these Terms. If you do not agree, you must not use the services.

These Terms apply to all users of Lungoor Notes, including individuals, professionals, teams, and businesses using our website, desktop applications, and related services. They supplement the Lungoor Terms of Service with the terms specific to Lungoor Notes.

These Terms are a contract between you and Surfboard India Pvt Ltd, incorporated in Maharashtra, India, with its registered office at 8th Floor, New Viva College, Y.K Nagar, Virar West, Palghar, Maharashtra 401 303. Contact: [email protected] | Phone: +91 88063 73111

Your account, credits and account deletion are handled by shared Lungoor account services operated by Surfboard India Pvt Ltd.

2. Eligibility

Lungoor Notes is intended only for users who are 18 years of age or older.

By creating an account, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into these Terms.
  • The information you provide is accurate and complete.

We reserve the right to suspend or terminate accounts that do not satisfy these requirements.

3. Description of Services

  • Meeting capture and transcription, from your microphone and your computer's audio output
  • Automatic meeting detection, performed locally on your device
  • AI-generated summaries, action items, decisions, topics and risks
  • Summaries produced from templates and recipes you configure
  • A note editor, sticky notes, and a custom speech dictionary
  • Folders, todos, meeting search, advanced search, and chat across your meetings
  • Cross-meeting insights and a people and companies view
  • Google Calendar integration, for upcoming meetings, join links and pre-meeting reminders
  • Sharing and collaboration, including sharing with individuals, your organisation, by email, or by public link
  • Optional Slack and Atlassian Jira integrations, including creating Jira issues from meeting notes and transcript topics
  • An optional Model Context Protocol (MCP) server for connecting third-party AI clients
  • API tokens for approved integrations
  • Importing meeting notes from supported external sources

We continuously improve Lungoor Notes, and features may change, evolve, or be discontinued over time. Features vary by platform.

4. Account Responsibilities

To access certain features, you must create an account. You agree that:

  • The information you provide is accurate and current.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities conducted through your account.
  • You will promptly notify us of any unauthorized use of your account.

Sign-in is Google OAuth only and requires a work or organisation email on a non-consumer domain (not personal providers such as Gmail, Yahoo, Outlook.com, or similar free email services). After sign-in, you may connect Google Calendar using any Google account you authorise.

Your account is associated with an organisation derived from your email domain. Colleagues you have shared a meeting with can see you in your organisation's people directory, and you can share meetings with your organisation. See Section 11 of our Privacy Policy.

We may suspend or terminate accounts that violate these Terms or compromise the security of the platform.

5. Recording, Consent & Your Responsibilities

This section is important. Read it before you capture a meeting.

What the service records

When you start a capture, Lungoor Notes records both your microphone and your computer's audio output (system audio). In a video call, the system audio includes the voices of every other participant. Both sources are transcribed and stored in your meeting record. Lungoor Notes does not record video and does not capture your screen contents.

The consent obligation is yours

You are solely responsible for notifying every participant that the meeting is being recorded and transcribed, and for obtaining their consent before you start capturing.

Recording and wiretapping laws vary significantly by country, and within countries by state or province. Some jurisdictions permit recording with the consent of one party; many require the consent of all parties. Some impose criminal as well as civil liability. Whether a given meeting may lawfully be recorded depends on where you are, where each participant is, and the nature of the conversation - facts that only you know.

Accordingly, you agree that:

  • You will determine which laws apply to each meeting you capture and comply with them
  • You will inform all participants, in advance, that the meeting is being recorded and transcribed by Lungoor Notes, and obtain any consent the law requires
  • You will stop capturing immediately if any participant objects or withdraws consent
  • You will not capture any meeting where recording is prohibited by law, by a confidentiality obligation, or by the policies of your employer or any participant's employer
  • You will comply with all applicable data protection law in respect of the personal data of other participants that you cause to be processed through the service
  • You are the controller of the meeting data you create, and we act as your processor in producing it
  • If you use speaker labels or enroll your own voiceprint, you will tell other participants that the meeting is being recorded, transcribed, and may be separated into speaker labels, and you will obtain any consent the law requires for that processing
  • You will not enroll or store a voiceprint for any other person through Lungoor Notes unless that person has consented (or your organisation has a lawful basis and process that covers them)
  • Suggested assignees created from speaker labels are suggestions only until you confirm them; you remain responsible for incorrect attribution

What we provide

As a convenience only, Lungoor Notes displays a consent reminder in the transcription view and publishes consent guidance at lungoor.ai/docs/notes/getting-consent. These are informational aids, not legal advice, and they do not satisfy your obligations. We do not provide, and are not obliged to provide, automated in-meeting announcements, recording watermarks, or participant consent capture. The presence or absence of any such feature does not shift the obligation in this section.

Indemnity

You agree to indemnify, defend and hold harmless Surfboard India Pvt Ltd, its officers, directors, employees and agents from and against any claim, demand, proceeding, loss, liability, damage, penalty, fine, cost or expense (including reasonable legal fees) arising out of or related to: (a) your recording or transcription of any meeting or conversation; (b) your failure to give notice or obtain consent as required by this Section 5; (c) any breach by you of applicable recording, privacy or data protection law; or (d) any claim brought by a meeting participant or their employer in relation to data you captured through the service.

This indemnity survives termination of these Terms.

6. Acceptable Use

You agree to use Lungoor Notes only in compliance with applicable laws. You must not:

  • Use the services for illegal or fraudulent purposes.
  • Record or transcribe any meeting in breach of Section 5.
  • Capture conversations covertly, or in any setting where participants have a reasonable expectation of privacy and have not consented.
  • Upload unlawful, abusive, or malicious content.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Reverse engineer, copy, or exploit the platform except where permitted by law.
  • Interfere with the operation, reliability, or security of Lungoor Notes.
  • Use automated systems to abuse or overload the platform.
  • Circumvent usage limits, billing mechanisms, or security controls.
  • Share access to your account, or use another person's account.
  • Process special categories of personal data, or data subject to sector-specific regulation, without ensuring you have a lawful basis and appropriate safeguards.

Violation of these Terms may result in suspension or permanent termination of your account.

7. Sharing & Public Links

You control whether and how a meeting record is shared. Nothing is shared by default. You may share a meeting or folder with named individuals, with everyone in your organisation, by forwarding a summary to an email address, or by a public link.

A public link is public. Anyone who has the link can read the meeting summary and ask AI questions about it without signing in, and can forward the link to anyone else. Do not create a public link for a meeting containing confidential, personal or regulated information unless you accept that consequence.

You are responsible for what you share and with whom, and for ensuring you have the right to share it - including the rights of other meeting participants whose speech and personal data appear in the record. Once content has been read, copied or forwarded by a recipient, it cannot be recalled, and removing a share grant or disabling a link does not undo prior access.

8. Connected AI Clients (MCP)

Lungoor Notes offers an optional Model Context Protocol (MCP) server that lets you connect a third-party AI client or assistant to your Lungoor Notes data. It is off by default and operates only if you authorise a client through an OAuth flow.

  • A connected client gets read-only access to your meetings, transcripts, summaries, folders, insights, recipes and meeting-related people, with the same visibility you have. It cannot create, modify or delete your data, and cannot access your credentials, OAuth tokens or payment information
  • By connecting a client you instruct us to disclose that data to it, including Google Calendar-derived fields such as meeting titles and attendee lists
  • Once data reaches the client, it is governed by that provider's terms and privacy policy, not ours. We have no control over, and accept no responsibility for, how a connected client or its provider stores, transmits, uses or discloses data it receives
  • You are responsible for choosing which clients to connect, for the security of the credentials those clients hold, and for ensuring that disclosure to them is permitted - including in respect of other meeting participants' data
  • You may revoke a client's access at any time in Settings. Revocation stops further access immediately but does not retrieve data already received

Connect only clients you trust.

9. Credits, Billing & Payments

Certain Lungoor Notes features require prepaid credits. By purchasing credits, you agree that:

  • Credits are consumed when you use paid features.
  • Credit usage varies depending on the feature or processing mode used.
  • Unless otherwise stated, purchased credits do not expire. Promotional or trial credits may carry an expiry, which is shown when they are granted.
  • Credits have no cash value and are not transferable.
  • Credits remaining in your account are forfeited if you delete your account, and you must acknowledge this before deletion can proceed.
  • An account carrying an outstanding negative credit balance must settle that balance before it can be deleted.
  • You are responsible for any applicable taxes.

Payments are securely processed by third-party payment providers.

Lungoor Notes does not collect, store, or process your complete payment card information, UPI credentials, or other sensitive payment information. Payment credentials are handled directly by certified payment processors in accordance with their own security and privacy practices.

We do receive and store a transaction record for each successful payment - including the payment method and, where applicable, the UPI VPA or masked card details - for billing history, reconciliation, refunds and statutory accounting. See Section 18 of our Privacy Policy.

10. Refund Policy

Refund requests may be approved in circumstances including:

  • Duplicate payments
  • Billing errors
  • Technical issues preventing access to purchased services
  • Accidental purchases reported within a reasonable period

Refund requests are reviewed individually.

To request a refund, contact: [email protected]

Approval of refunds remains at our reasonable discretion, subject to applicable consumer protection laws.

11. AI Disclaimer

Lungoor Notes uses artificial intelligence to assist with transcription, summarization, action item extraction, translation, search and other productivity features.

AI-generated output may occasionally contain inaccuracies, omissions, or formatting errors, and can misattribute statements or omit material points. Users should carefully review AI-generated content before relying upon it, and should not treat it as a verbatim or legally reliable record of a meeting.

Lungoor Notes should not be relied upon as the sole basis for:

  • Legal advice
  • Medical decisions
  • Financial decisions
  • Regulatory compliance
  • Safety-critical activities

You remain responsible for reviewing and verifying all generated content before using or sharing it.

12. Speech-to-Text & Data Processing

Speech and meeting data processed by Lungoor Notes can be retained as transcription records and related artifacts, as described in our Privacy Policy.

Transcription runs in one of two modes, which you choose in Settings: a cloud speech-to-text provider (default), or Apple's on-device speech models on macOS, in which case your audio is transcribed locally and does not leave your device for transcription. In both modes the resulting text is stored in your meeting record and processed for AI features.

Your meeting content is also indexed automatically and on an ongoing basis - including as vector embeddings - so that search, cross-meeting insights and AI retrieval work. This indexing happens without a separate request from you each time.

We do not retain your audio recordings. Audio is streamed for transcription and discarded once the text is produced.

13. Service Availability

We strive to provide reliable and uninterrupted services. However, Lungoor Notes may occasionally experience interruptions due to:

  • Scheduled maintenance
  • Infrastructure upgrades
  • Internet connectivity issues
  • Third-party service disruptions
  • Force majeure events

Although we target high service availability, uninterrupted access cannot be guaranteed. A capture may fail, be interrupted, or produce an incomplete transcript - for example if a device permission is revoked mid-meeting, network connectivity drops, or a provider is unavailable. Lungoor Notes is not a system of record; keep your own notes of anything you cannot afford to lose.

14. Third-Party Services

Lungoor Notes uses third-party service providers only to deliver the service. The categories of providers we engage - speech processing, AI language processing, cloud infrastructure, payment processing, authentication, product analytics, customer support, transactional email delivery and error monitoring - and what each receives are described in Section 21 of our Privacy Policy. We will provide the current list of named processors on request to [email protected].

Integrations you connect yourself - Google Authentication, Slack, Atlassian (Jira Cloud), and any AI client you connect over MCP - are named there. Payments are handled by certified third-party payment providers.

These providers process personal information only on our behalf and only for delivering Lungoor Notes services. They are contractually prohibited from using your information for unrelated purposes or for training their own models.

15. Cookies & Analytics

Lungoor Notes uses authentication cookies to maintain sessions and analytics cookies as described in Section 12 of our Privacy Policy. Identifying values - names, email addresses, meeting titles and record identifiers - are stripped from analytics events before they leave the app. Analytics information is associated with a pseudonymous identifier and is not used for advertising.

16. Google User Data

Collection, use, storage, sharing, retention, and your controls for Google user data (including Calendar) are governed by our Privacy Policy. In summary:

  • Lungoor Notes currently supports Google Calendar only
  • It requests read-only calendar event access when you sign in with Google and when you connect additional Google Calendar accounts, and reads only the primary calendar of each connected account
  • The fields it reads are the event title, start and end time, attendees, event id, and the conferencing fields (conferenceData, hangoutLink and location) used solely to detect the meeting platform and join link. It does not read event descriptions, organiser details, attachments or other calendar fields
  • Sign-in is Google OAuth only and requires a work or organisation email on a non-consumer domain
  • You can disconnect additional Calendar connections in Settings
  • Sign-in Calendar access is revoked via Google Account permissions
  • Deleting your account removes data for all connected Calendar accounts

17. Limited Use Compliance

Lungoor Notes' use of data received from Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements. We do not:

  • Use Google user data for advertising or ad targeting
  • Sell Google user data to any third party
  • Use Google user data to train AI or machine learning models
  • Share Google user data beyond the service providers described in our Privacy Policy, and only to the extent described there - except where you yourself direct a disclosure by sharing a meeting or connecting an AI client
  • Allow human review of Google user data, except with your explicit consent for a support request or where required by law
  • Use Google user data for any purpose other than providing the meeting workflow features you have requested

18. Data Retention, Deletion & Recovery

Retention and deletion of Google user data and meeting data follow our Privacy Policy. In summary:

  • You can request deletion of your Lungoor account from your Lungoor account settings, or by emailing [email protected]
  • On request, your account is suspended, your sessions are revoked and your data is frozen
  • You have a 30-day recovery period in which you can restore the account by signing in and completing email verification
  • After 30 days, your account and associated data are permanently deleted across both the shared Lungoor account services and the Lungoor Notes services - including meeting records, transcripts, summaries, derived artifacts, search indexes and embeddings, folders, todos, share grants and integration tokens. This is irreversible
  • An account may go through the delete-and-restore cycle up to three (3) times; a fourth deletion is final and cannot be restored
  • Remaining credits are forfeited on deletion, and an outstanding negative balance must be settled first
  • Payment and transaction records are anonymised and retained for statutory accounting purposes, and an irreversible hash of your email address is retained to prevent abuse of first-time credit offers
  • Content you shared with others before deletion cannot be recalled

We aim to send an initial response to a deletion enquiry within 24-48 business hours.

19. Your Controls & How to Revoke Access

You can disconnect additional Calendar integrations, Slack, Jira, and any connected AI client in Settings, revoke share grants and public links on meetings and folders you own, switch transcription to Apple's on-device engine on macOS, and turn off automatic meeting detection. You can also revoke OAuth access directly with the provider:

  • myaccount.google.com/permissions - Google; Lungoor Notes may appear as Lungoor Notes or Lungoor Notes AI
  • id.atlassian.com/manage-profile/apps - Jira
  • Remove Lungoor Notes from your Slack workspace

Sign-in Google access cannot be revoked inside Lungoor Notes - use Google Account permissions. Full details are in our Privacy Policy.

20. Intellectual Property

All software, technology, designs, branding, documentation, interfaces, logos, graphics, and content associated with Lungoor Notes are owned by or licensed to Surfboard India Pvt Ltd.

Except as expressly permitted under these Terms, you may not:

  • Sell
  • Reverse engineer
  • Create derivative works

without prior written permission.

Nothing in these Terms transfers ownership of our intellectual property to you.

21. User Content

You retain ownership of the content you submit to Lungoor Notes.

By using the services, you grant us a limited license to host, process, transmit and display your content solely for the purpose of providing the requested features, including to those you choose to share it with.

We do not claim ownership of your content.

Except where required by law or with your explicit consent, we do not use your content to train external AI models.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Surfboard India Pvt Ltd shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Lost profits
  • Business interruption
  • Loss of goodwill
  • Loss of data
  • Errors in AI-generated outputs
  • Decisions made based on AI-generated content
  • Failed, interrupted or incomplete meeting captures
  • Any claim arising from your recording of a meeting, or your failure to give notice or obtain consent under Section 5
  • The acts or omissions of any third-party AI client you connect, or any recipient of content you shared

Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.

23. Suspension & Termination

You may stop using Lungoor Notes at any time. You may request deletion of your account in accordance with our Privacy Policy.

We may suspend or terminate your access if:

  • You violate these Terms.
  • You misuse the platform.
  • Your activities pose a security risk.
  • We are required to do so by law.

Upon termination:

  • Your right to access Lungoor Notes ends immediately.
  • Outstanding payment obligations remain.
  • Sections relating to recording, consent and indemnity (Section 5), intellectual property, liability, governing law, and dispute resolution survive termination.

24. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Any dispute arising out of or relating to Lungoor Notes shall be subject to the exclusive jurisdiction of the competent courts located in Thane, Maharashtra, India.

25. Changes to These Terms

We may update these Terms from time to time.

For material changes, we will notify registered users before the updated Terms become effective.

Continued use of Lungoor Notes after the effective date constitutes acceptance of the updated Terms.

Where required by applicable law, we may request your renewed consent.
